Welcome to Archive Weddings, operated by Benjamin Small and Isabell Beenker. We document weddings through photography and videography, combining digital and analogue processes with our own artistic approach to storytelling.
These Terms & Conditions explain the general terms under which we provide our services. They should be read alongside the individual Wedding Photography & Videography Agreement signed by each couple.

Archive Weddings is the name under which Benjamin Small and Isabell Beenker offer their photography and videography services. Unless otherwise agreed in writing, the contractual parties are Benjamin Small and Isabell Beenker, acting in their own names. The services may be provided jointly or individually, as agreed for each booking.
## 2. BOOKINGS & CONTRACT FORMATION
All bookings are subject to availability and written confirmation.
A booking becomes binding once the individual agreement has been concluded by the relevant parties and the required deposit has been received, subject to applicable law.
The individual agreement sets out the selected package, coverage period, deliverables, agreed fees, additional services and expected delivery timeframes.
Any changes to the booking must be agreed upon in writing.
## 3. PACKAGES & ADDITIONAL SERVICES
Archive Weddings offers the following wedding packages:
- THE FULL ARCHIVE
- THE CELEBRATION
- THE CIVIL
- CUSTOM PACKAGE
The exact services included in each package will be confirmed in the individual booking agreement.
Depending on availability and the selected package, additional services may include couple shoots, private vow coverage, an additional cinematographer, VHS camcorder footage, short social media films, all stills from the gallery, express delivery, additional Super 8 film cartridges, prints and photo books.
Only services expressly included in the signed agreement are guaranteed. Additional services must be agreed upon before they are provided and may incur additional charges.
## 4. PRICING & PAYMENT
All prices are stated in euros (€).
The total agreed contract amount, including the selected package, additional services and any agreed travel costs, will be specified in the individual agreement.
### 4.1 Deposit
A deposit equal to 50% of the total agreed contract amount is payable upon signing the agreement.
The wedding date is considered reserved once the deposit has been received.
The deposit secures the date and allows us to reserve availability and undertake preparation for the wedding.
The treatment of the deposit in the event of cancellation is subject to the booking agreement and applicable law.
### 4.2 Remaining Balance
The remaining 50% of the total agreed contract amount is payable within seven (7) calendar days after delivery of all agreed media, including the finished photographs, wedding film and other deliverables included in the booking.
### 4.3 Additional Costs
Any additional services, products, travel expenses or other charges must be communicated to the clients and agreed upon in advance.
No additional travel costs or mileage allowances will be charged unless agreed upon.
Optional products, such as prints and photo books, may be purchased separately.
### 4.4 VAT
Where the small business scheme under Section 19 of the German Value Added Tax Act (UStG) applies, VAT is not charged or separately itemised in accordance with that provision.
## 5. PHOTOGRAPHY & ANALOGUE FILM
Our photography may combine digital photography and analogue film, depending on the selected package.
The individual agreement will specify the minimum number of edited digital photographs and the agreed quantities of analogue film.
Analogue photographs are additional to the agreed minimum number of digital photographs unless expressly agreed otherwise.
### 5.1 Film Development & Processing
Analogue photography is a manual process involving the handling, transport, development and digitisation of physical film.
Film is processed by an independent professional laboratory. We handle and transport all film with reasonable care, but the laboratory's equipment, processing procedures and working conditions are outside our direct control.
Analogue photography carries inherent risks, including accidental damage, processing defects, exposure issues, colour variations, loss or the possibility of unusable images.
We take reasonable precautions to minimise these risks but cannot guarantee that every analogue frame will produce a usable image.
Any liability arising from loss, damage or processing defects will be determined in accordance with the individual agreement and applicable law. Nothing in these terms excludes liability where such exclusion is prohibited by law.
## 6. VIDEOGRAPHY & SUPER 8
Wedding films are professionally edited in the distinctive artistic style of Archive Weddings.
The approximate duration of the final wedding film, the inclusion of Super 8 footage and any additional video deliverables will be specified in the individual agreement.
### 6.1 Super 8 Development
Super 8 is an analogue filming format that requires physical film development and digitisation by an external professional laboratory.
The process takes a minimum of approximately six (6) weeks for development and digitisation, followed by an additional two (2) to three (3) weeks for editing.
The Clients acknowledge that this is a manual process involving an external laboratory and that the timing depends partly on the laboratory's processing schedule.
We handle and transport Super 8 film with reasonable care. However, the risks associated with analogue film processing described in Section 5 also apply to Super 8 footage.
## 7. DELIVERY TIMEFRAMES
Our standard delivery timeframes are as follows, unless otherwise agreed in writing:
- Photography: Up to four (4) weeks after the wedding day.
- Wedding films without Super 8: Up to eight (8) weeks after the wedding day.
- Wedding films including Super 8: Up to ten (10) weeks after the wedding day.
The extended timeframe for Super 8 films accounts for external film development and digitisation, followed by editing.
Express delivery is available only when expressly selected and agreed upon in writing. The applicable delivery timeframe will be confirmed separately.
We aim to deliver all work as promptly as reasonably possible while maintaining our established creative standards. If an unexpected circumstance materially affects delivery, we will communicate the delay and work towards completion as soon as reasonably possible.
## 8. EDITING & ARTISTIC STYLE
Photography and videography are creative services. Clients book Archive Weddings in recognition of our individual artistic approach and previous work.
We retain creative discretion over the selection, editing and presentation of the final deliverables, including:
- Photograph selection
- Colour correction and colour grading
- Black-and-white conversions
- Film looks and film emulations
- Cropping and exposure adjustments
- Video editing and pacing
- Music selection, where applicable
- Narrative structure and storytelling
- Overall artistic presentation
Every wedding is unique, and the final results will vary depending on the circumstances of the day, including lighting, weather, venue restrictions, schedule changes and other factors.
We make reasonable efforts to capture the important moments of each wedding but cannot guarantee that every guest, scene or requested photograph will be captured.
### 8.1 Retouching & Amendments
Our standard editing process reflects our own artistic style. Individual retouching, object removal, extensive alterations and substantial re-editing are not included unless expressly agreed upon.
Where technically possible, requests to convert photographs between colour and black and white may be considered.
Additional editing work, if agreed, may incur additional charges.
## 9. DELIVERY FORMATS & ONLINE GALLERY
Digital photographs are delivered in high-resolution JPEG format through a private, password-protected online gallery, normally hosted by Pic-Time.
Finished wedding films are delivered in MP4 format through a secure download link or another agreed digital delivery method.
Delivered files are supplied without watermarks and in a resolution suitable for the agreed private use.
Alternative delivery methods, including USB sticks or external hard drives, may be arranged by prior agreement. Additional costs will be communicated in advance.
Clients are responsible for downloading and securely storing their files after delivery. Online galleries and download links may not remain available indefinitely.
## 10. DATA BACKUP & ARCHIVING
We take reasonable precautions to protect photographic and video files throughout the production process.
Where technically applicable, our backup procedures include encrypted cloud storage and local backup copies.
These measures reduce the risk of accidental loss but cannot eliminate every possible technical failure.
Following delivery, clients are responsible for the long-term storage and backup of their files. We do not guarantee permanent archiving or indefinite access to delivered files.
This provision does not exclude any mandatory statutory rights or liability that cannot lawfully be excluded.
## 11. COPYRIGHT & CLIENT USAGE RIGHTS
All photographs, films and other creative works produced by Archive Weddings remain protected by applicable copyright law.
Upon full payment, clients receive a non-exclusive, worldwide right to use the delivered photographs and videos for private, non-commercial purposes without a time limit.
This includes downloading, storing, printing and sharing the delivered media with family and friends, as well as posting it on personal social media accounts.
Commercial use, resale, licensing or other exploitation beyond the agreed private usage rights requires prior written permission from the relevant rights holder, subject to applicable law.
Any third-party music, footage or other licensed materials remain subject to the relevant licence restrictions.
## 12. PORTFOLIO, MARKETING & PRIVACY
We value the privacy of every couple and their guests.
We may wish to showcase selected photographs and video excerpts on our website, social media platforms, portfolio presentations, printed materials and other promotional channels.
Where required by law, identifiable wedding photographs and video footage will be used for portfolio or marketing purposes only with the relevant explicit consent.
Providing consent is voluntary and is not a condition of booking our services.
Consent may be withdrawn with effect for the future in accordance with applicable law.
Wedding photographs may also contain identifiable guests or other individuals. Consent from the couple does not automatically resolve every privacy or image-rights issue concerning third parties.
Personal data will be handled in accordance with applicable data protection law. Further information about data processing, retention, recipients and individual rights will be provided in our separate Privacy Policy.
## 13. CLIENT RESPONSIBILITIES
Clients are responsible for providing accurate booking details and communicating relevant information in good time.
This includes the wedding schedule, locations, important moments, venue restrictions and any relevant access or travel arrangements.
Clients should inform us of restrictions imposed by venues, officiants or other service providers before the wedding.
We cannot guarantee photographs or footage that cannot reasonably be captured because of restrictions, schedule changes, missing information or circumstances outside our reasonable control. Any resulting liability remains subject to applicable law.
## 14. EQUIPMENT & TECHNICAL FAILURES
We use professional photography and videography equipment and take reasonable precautions to minimise interruptions caused by technical issues.
Backup equipment may include spare batteries and additional cameras.
If equipment failure or another technical issue affects the agreed services, we will make reasonable efforts to minimise the impact and continue coverage where possible.
Any resulting liability, refund or other remedy will be determined in accordance with the booking agreement and applicable law.
## 15. CANCELLATION & RESCHEDULING
Clients who wish to cancel their booking must notify Archive Weddings in writing as soon as reasonably possible.
Cancellation charges, deposit retention and any refund due will be determined by the individual booking agreement and applicable law, taking account of any mandatory consumer protections.
No provision in these terms is intended to exclude a statutory right of withdrawal where one applies.
### 15.1 Rescheduling
If a wedding is rescheduled, we will make reasonable efforts to accommodate the new date.
If we are available, payments already made will generally be credited towards the rescheduled booking, subject to written confirmation.
If we are unavailable on the new date, the parties will determine the available options in accordance with the booking agreement and applicable law.
Any change of date must be confirmed in writing.
## 16. CANCELLATION OR INABILITY TO PERFORM BY ARCHIVE WEDDINGS
If illness, accident or another unforeseen circumstance prevents us from providing the agreed services, we will make reasonable efforts to arrange a suitable replacement photographer or videographer where practicable.
Any replacement will be selected with the aim of providing a comparable professional standard.
If no suitable replacement can be arranged, payments will be refunded to the extent required by the booking agreement and applicable law.
Any further remedies or claims will be determined under applicable law.
## 17. FORCE MAJEURE
Neither party shall be held responsible for a failure to perform contractual obligations to the extent that performance is prevented by extraordinary circumstances beyond that party's reasonable control.
Such circumstances may include natural disasters, serious public emergencies, war, certain government restrictions or comparable events.
The affected party will inform the other party as soon as reasonably possible. Both parties will make reasonable efforts to find a practical solution, including rescheduling where appropriate.
Any financial consequences will be determined in accordance with the booking agreement and applicable law.
## 18. TRAVEL & ADDITIONAL EXPENSES
Any travel expenses included in the booking will be specified in the individual agreement.
Additional expenses will only be charged where disclosed and agreed upon in advance.
If changes requested by the clients result in additional travel, accommodation or other costs, the parties will agree on those costs before they are incurred wherever reasonably possible.
## 19. ADDITIONAL PRODUCTS & THIRD-PARTY SERVICES
Prints, albums, photo books and other optional products may be available through the online gallery or by separate arrangement.
Some products and services involve third-party suppliers, including film laboratories, printing services and online gallery providers.
We take reasonable care when working with these providers but cannot directly control every aspect of their operations.
The rights and remedies applicable to a particular product or service will be determined by the relevant agreement and applicable law.
## 20. COMPLAINTS & COMMUNICATION
If clients have concerns about their booking, delivery or the services provided, they are encouraged to contact us directly.
Email: Isabell.beenker@gmx.de
Please include the wedding date and a clear description of the concern so that we can review the matter efficiently.
We aim to address concerns professionally and in good faith.
Nothing in this section limits any statutory rights or remedies available to clients.
## 21. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time to reflect changes in our services, business practices or legal requirements.
The version applicable to an individual booking will be determined in accordance with applicable law and the information provided when the contract was concluded.
Changes published on the website do not automatically amend an existing signed booking agreement. Amendments to an existing agreement must be made in accordance with that agreement and applicable law.
## 22. SEVERABILITY
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
The invalidity of an individual provision does not automatically invalidate the entire agreement.
## 23. APPLICABLE LAW & CONSUMER RIGHTS
These Terms & Conditions and the contractual relationship with Archive Weddings are governed by the laws of the Federal Republic of Germany, subject to mandatory legal protections applicable to consumers.
Nothing in these terms is intended to restrict statutory consumer rights, mandatory withdrawal rights or other rights that cannot lawfully be excluded.
Where a dispute arises, the parties are encouraged to seek an amicable resolution. Applicable jurisdiction and dispute-resolution arrangements will be determined in accordance with the relevant legal requirements.
